1. HOW TO ENTER
a. The SING LIKE THE JONAS BROTHERS contest (the “Contest”) will begin at 7am eastern time on Monday, June 23rd and end on Wednesday, July 23rd at 1pm eastern time (the “Contest” period).
b. Participants may enter via the following method: Beginning at 7am on Monday, June 23rd, 2008, log onto www.965TIC.com.. Simply click on the Jonas Brothers banner and upload a video of up to 5minutes of you or you and up to 9 of your friends singing a Jonas Brothers song in a cappella or accompanied by music. All of the individuals in the submitted video must be 13 years of age or older. All entries submitted become the sole property of WTIC and will not be acknowledged or returned. For purposes of these Official Rules, “receipt” of an online entry will be solely determined when the www.965TIC.com web server records the entry information. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible by assigning email address or the domain associated with the submitted email address. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of an entry form for purposes of these Official Rules. Use of any device to automate entry is prohibited. WTIC’s computer is the official time keeping device for this Contest. The Station is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches. All uploads must be received by 11:59pm on Monday, July 7th, 2008.
c. Only one entry per person.
2. Eligibility Restrictions:
a. Entrants must be, at the time of entry, U.S. residents who are 13 years of age and older who reside in the State of Connecticut. Employees of WTIC-FM (the “Station”), its licensee, CBS Radio Inc., subsidiaries and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Hartford, CT metropolitan area and the members of their immediate families and or households are ineligible to participate or win.
b. Only one winner per household is permitted in any Station contest.
c. The video submitted for this contest (the “Video Entry”) and its content will become the property of the Station and will not be returned. Each Video Entry must be the original creative work of each contestant. The Station, at its sole discretion, reserves the right to disqualify and/or destroy any Video Entry, if such Video Entry contains illegal, indecent, pornographic, sexually explicit content, or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such Video Entry contains material whose content is deemed at the sole discretion of WTIC-FM to be unsuitable for public viewing.
d. Contestants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements, and the Station will also delete any votes received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
e. In the event that the winner is under the age of 18, a parent or legal guardian must sign a release on behalf of the minor to be eligible to receive a prize. The parent or legal guardian must then provide government issued photo identification prior to receiving the prize.
f. Each individual in the video must execute and return a release by Tuesday, July 8th at 11:59pm eastern time or the Video Entry will NOT be entered into the Contest or posted on the Station’s website for voting. If an individual is under the age of 18, his or her parent or legal guardian must execute and return the release on behalf of the minor.
3. Prize(s).
a. The winner will win one (1) prize. The prize consists of ten (10) laws seat tickets to the Jonas Brother concert at the Dodge Music Center in Hartford on Saturday, July 26th, 2008 and ten (10) meet and greet tickets with the Jonas Brothers on the night of the show. All tickets are good whether rain or shine and no substitute prize will be awarded if the event is delayed or cancelled.
b. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
c. All prizes or prize certificates may be picked up at the office of the Station at the address below. The winner will forfeit any prize or prize certificate not claimed by 1pm on Thursday, July 24th. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Station is not responsible for the safe arrival of a prize or prize certificate.
4. WINNER SELECTION AND NOTIFICATION
a. Decisions of the Station management with respect to the contest are final.
b. Contestants must enter as described above in section 1 b of these Official Rules. On Wednesday, July 9th at 12Noon, 965TIC judges will review the videos and select ten (10) finalists based on the following criteria, and each criteria will carry equal weight, with a scoring system of 1-10. The three categories are 1.) Stage Presence, 2.) Voice, and 3.) Overall Performance.
c. The videos of these ten (10) finalists will then be posted on a webpage in the contest section of www.965TIC.com for listener voting. Beginning on Thursday, July 10th at approximately 7am eastern time and ending on Wednesday, July 23rd at 12Noon eastern time, listeners will be able to view the videos and vote online by selecting the video they think is the best. Only one vote per person please. Once the voting period has ended, station staff will tally all the online votes to determine the winner. At approximately 1pm eastern time on Wednesday, July 23rd the contestant whose video received the most number of votes from among the ten (10) videos posted online will be deemed the winner, upon confirmation of eligibility. In the event of a tie, the entries with the tied number of votes will be pooled together and the winner will be determined through a random drawing of such entries.
d. The odds of winning, in part, depend upon the number of eligible entries received.
e. The winner will be notified by phone by WTIC-FM’s promotions department on Wednesday, July 23rd by 5pm eastern time. If the winner cannot be contacted within 1 day of the initial notification attempt, or does not execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form by 12Noon on Thursday, July 24th, 2008, the prize will be forfeited and an alternate winner may be selected by selecting the runner up entry with the most votes.
5. CONDITIONS
a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the contest, the winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Station in its sole discretion may require contest winners (and their travel companions, if any) to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.
d. The Station reserves the right to make changes in the rules of the contest, including the substitution of a prize or equivalent value, which will become effective upon announcement.
e. The Station, in is sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the Station’s website or who is otherwise in violation of the rules. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of the Station.
g. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.
h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of
WTIC-FM/Sing Like the Jonas Brothers , 10 Executive Drive, Farmington, CT 06032.
6. INTERNET SWEEPSTAKES PRIVACY POLICY
a. By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at www.965tic.com.
VIDEO SUBMISSION RELEASE
Submitter hereby provides a video (“Video”) via the online submission form at www.965TIC.com to CBS Radio Inc., (“CBS Radio”), owner and operator of Radio Station WTIC-FM (the “Station”) under the following terms (“Agreement”), and in consideration of the potential publicity and promotional value to submitter from CBS Radio’s possible broadcast, internet transmission, or other further dissemination of the Video(s):
1. I consent to the unrestricted use, publication, scanning, editing, cropping, resizing, viewing, broadcast, distribution, reproduction, display, and/or duplication of the Video(s) by CBS Radio, the Station or their affiliated entities (the “Released Parties”) for advertising and publicity purposes relating to CBS Radio or the Station or any of their affiliated entities, or for any other lawful purpose, in any media now known or hereinafter invented without any additional financial or other compensation. Under no circumstances will the Released Parties be held liable or responsible for the content of the Video(s) or for the authorized or unauthorized use, editing, viewing, broadcast, distribution and/or duplication of the Video(s). I consent to the use of the Video(s) or for any other lawful purpose, in any media now known or hereinafter invented without further notice or permission. I understand and agree that I have no right to approve or control the manner in which the Video(s) may be used or displayed.
2. I acknowledge that CBS Radio is and shall be the sole and exclusive owner of the Video(s) and shall have the right to exploit the Video(s). I understand that the use and exploitation of the Video(s) may subject me to risk of notoriety, publicity, ridicule, scorn and/or indignity.
3. Submitter represents and warrants the following:
a. The Video submitted is a Video of me.
b. Submission of the Video does not violate any agreement or understanding in place with another party, including other organizations, and former or current employers, or their policies and procedures or the like that govern Submitter.
c. The Video is Submitter’s own creation and Submitter owns all rights in and to the Video, including, but not limited to, copyrights, digital rights and publicity rights. If Submitter is not the holder of such rights, the holder of them has completely and effectively waived all such rights and validly and irrevocably granted to Submitter the right to grant the license set forth in this Agreement.
d. The Video is not indecent, illegal, pornographic, sexually explicit, or offensive and does not contain material showing aberrational behavior, graphic violence or drug abuse. The Video does not defame, invade the privacy of, or infringe upon or violate any rights of any kind whatsoever of any individual or entity.
e. The Video does not violate any law, rule, or regulation of any governmental entity.
f. The Video is not subject to any obligation of confidentiality.
g. Submitter has not accepted or agreed to accept, or paid or agreed to pay, any money, service or other valuable consideration for the inclusion of any matter in the Video.
4. I AGREE THAT I WILL NOT MAKE ANY CLAIM AGAINST CBS RADIO, THE STATION, IT’S LICENSEE, CBS RADIO INC., ITS PARENT CORPORATION, OR ANY OF THEIR SUBBSIDIARY OR AFFILIATED CORPORATIONS, THEIR AFFILIATED ADVERTISING AGENCIES, PARTICIPATING SPONSORS/PROMOTIONAL PARTNERS, OR THE OFFICERS, SHAREHOLDERS, DIRECTORS, EMPLOYEES, AGENTS AND REPRESENTATIVES OR ANY OF THESE COMPANIES (COLLECTIVELY, THE “RELEASED PARTIES”). I HEREBY RELEASE, DISCHARGE, HOLD HARMLESS, AND INDEMNIFY THE RELEASED PARTIES FROM ANY AND ALL LIABILITY FOR ANY LOSSES, CLAIMS, DAMAGES, DEMANDS, CAUSES OF ACTION, COSTS OR EXPENSES, INCLUDING REASONABLE ATTORNEYS’ FEES, NO MATTER HOW CAUSED, ARISING OUT OF OR OTHERWISE RELATING IN ANY WAY TO ANY BREACH OR ALLEGED BREACH BY ME OF ANY AFFIRMATION, UNDERTAKING, OR OBLIGATION OF MINE IN THIS RELEASE, OR AS A RESULT OF THE USE OF THE VIDEO FOR ANY PURPOSE, INCLUDING, BUT NOT LIMITED TO, ANY CLAIM OF COPYRIGHT INFRINGEMENT, INVASION OF PRIVACY OR RIGHT TO PUBLICITY, AND I ACKNOWLEDGE THAT NONE OF THE RELEASED PARTIES HAVE MADE ANY REPRESENTATION OR WARRANTY TO ME REGARDING THE VIDEO(S).
5. Submitter understands that submission of the Video does not obligate CBS Radio to broadcast or otherwise transmit, promote or use the Video. Submitter further understands that the Video will not be returned.
6. Submitter agrees that if Video is selected for broadcast, display or dissemination, CBS Radio may use Submitter’s full name, title of the Video, and city and state of residence and/or operation for the purpose of identifying, promoting and/or generating publicity for CBS Radio and/or its designees. CBS Radio will not disclose any other personally identifiable information to the public, unless it is necessary to a) conform to regulatory and legal requirements or comply with the legal process; b) protect the safety and security of its users, employees, or property; c) to defend the rights of the CBS Radio Entities; or d) enforce this Agreement, the Station’s Terms of Use, and/or Privacy Policy.
7. Submitter certifies that he/she is over thirteen (13) years of age.
8. Submitter understands and accepts CBS Radio’s Privacy Policy, Terms of Use, and these additional terms, without reservation.
9. I understand that this Release is intended to be as broad and inclusive as permitted by law, and I agree that if any portion of this Release is deemed invalid, the remainder will continue in full force and effect. I further understand that this Affidavit and Release is to be interpreted under the laws of the State of Connecticut, and I submit to the jurisdiction of the courts within the State of Connecticut and waive all objections to the jurisdiction or venue of such courts.
